The Core Effect

The Core Effect Pilates, Dutch Chamber of Commerce number: 87743930 (The Core Effect) provides an online service (The Core Effect service) that allows members to access Pilates related content (The Core Effect content). More specifically this means the digital content service provided by The Core Effect for discovery of and access to The Core Effect content, including all features and functionalities, video’s, blogs, recommendations, reviews, websites, and user interfaces as well as all content and software associated with The Core Effect service over the internet on TVs, computers, laptops, and other devices.

Any reference to ‘you’ indicates a person who visits the website, a person who watches The Core Effect content, a person who created a membership account, who uses the membership, or who pays for the membership.

Legal agreement
These user terms are a legal agreement between you and The Core Effect.

Membership
Registration
To make use of The Core Effect service and to have access to The Core Effect content you must create an account.

Trial/discounts
The Core Effect from time to time may offer free trials for a maximum of fourteen days or discounts. You are eligible for a trial only once. Trials or discounts will end automatically after completion. After a trial is completed, you can continue to use The Core Effect Pilates service via subscription.

Subscription
For a monthly, quarterly or yearly recurring fee (subscription fee) you will be granted unlimited access to The Core Effect service and content during the subscription period. Unless agreed otherwise, the subscription period is one (1) month, one (1) quarter or one (1) year.

Personal account
Your registered account is for personal use only and is not transferrable and is not for commercial use. Your password is also for personal use only and should not be shared with others.

Minimum age of 18 years old
Only if you are at least eighteen (18) years old and have the legal capacity to enter into a contract according to local law, can you subscribe for a membership. Minors may only use The Core Effect service under the supervision of an adult.

Prohibited use
You understand to use The Core Effect service with respect and you agree to not harm The Core Effect in any way. Without suggesting this is an exhaustive list, you explicitly agree to not:

• archive, copy, distribute, modify, publish, sell, or use content and information contained on or obtained from or through The Core Effect service
• insert any code or product or manipulate the content of The Core Effect service
• circumvent, remove, alter, or block any protections or security measures of The Core Effect service

Change of content
The Core Effect content can be changed unilaterally from time to time without prior notice. 

Health Disclaimer
You must always keep in mind that physical exercise could lead to (serious) injury. The strong recommendation therefore is that you obtain advice from a physiotherapist or a doctor before participating in any activity or exercise.

Payment
Payment methods
In order to make a purchase and become a member you must provide a valid payment method. The subscription fee for The Core Effect service will be charged to your payment method before the start of the subscription period. The billing cycle is equal to the subscription period of your choice. The subscription fee is subject to change. In any case you remain responsible for any uncollected amounts. If a payment is not successfully settled, The Core Effect may suspend your access to the service until the late payment was charged successfully.

Please note that some payment methods charge additional fees or local tax charges may be added. Please check with your payment method provider for further details.

Cancellation
You can cancel your membership at any time before the next billing cycle is due. You will continue to have access to The Core Effect service and content through the end of your billing cycle. Payments are nonrefundable. To cancel, please go to FAQ.

Intellectual Property
The Core Effect service, our devices and all data collected through our service (including all intellectual property rights in all preceding clauses) are and will remain the property of The Core Effect and our licensors. You may not use The Core Effect names, logos or trademarks for commercial purposes unless expressly permitted in writing. In addition, you may not attempt to register the names, logos or trademarks of The Core Effect or affiliated companies or otherwise claim ownership thereof. You may not reproduce, modify, adapt, alter, distribute, sell or lease any part of the app, service or data and you may not reverse engineer the source code of our software or attempt to extract it. 

Privacy
Your privacy is of great importance, not only to you but also to The Core Effect. You can find our Privacy policy here.

Liability
Any liability arising from or in connection with The Core Effect service shall be limited to the amount paid out by the insurer in the relevant case, plus the excess. If and insofar as no payment is made under the liability insurance, any liability of The Core Effect is limited to the amount equivalent to a subscription period of maximum one (1) year.

The Core Effect is only liable for damages arising directly from an error or shortcoming and is never liable for personal injury or consequential damages, including loss of income and or loss of profit or loss of third parties.

You indemnify The Core Effect against all claims by third parties relating in any way to your membership to The Core Effect service.

You must report any damages as soon as possible after its occurrence to The Core Effect in writing, stating the cause, nature and – as far as possible – the amount of the damages. Any claim against The Core Effect shall lapse one year after you were or could reasonably have been aware of the facts on which your claim was based, unless the claim was reported to The Core Effect in writing, stating the cause, nature and – if possible, the amount of the damage.

In any case you are required to enforce any right at the latest within one year after its occurrence. Any limitations for liability are not applicable in case of intent and/or conscious recklessness. 

Other 
Applicable law
These user terms are governed by and in accordance with Dutch law.

Unilateral changes
The Core Effect may, from time to time, change one or more user terms. You will be notified at least 30 days in advance. This will allow you to terminate your subscription before the new user terms take effect if you do not wish to accept the changes.

Invalid terms
If one or more of these user terms is (partially) invalid, non-binding or unenforceable with mandatory law, the other terms will remain in force. Parties agree to replace the invalid term in consultation with a valid, binding term that corresponds as much as possible to the original term also looking at the legal consequences, considering the nature, content, and purpose of the term.

Deviations
Deviations from these general terms and conditions apply only if confirmed in writing by The Core Effect.
